1. Acceptance of Terms
By accessing or using Uptime.cx ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
Uptime.cx provides automated AWS infrastructure analysis and uptime risk assessment services. Our Service:
- Connects to your AWS infrastructure with read-only access via AWS Marketplace integration
- Performs comprehensive architectural scans and analysis
- Generates AI-powered recommendations for improving system resilience
- Creates detailed reports that can be shared with your DevOps teams
- Provides access to AWS-specialized DevOps professionals for hire
3. Data Access and Privacy
3.1 Read-Only Access
Uptime.cx requires only read-only access to your AWS infrastructure. We do not and cannot:
- Modify, delete, or alter any of your AWS resources
- Access, read, or interact with your stored data (databases, S3 objects, etc.)
- Execute commands or make changes to your infrastructure
- Access application-level data or customer information
3.2 Data Collection
We collect only architectural metadata necessary for analysis, including:
- AWS service configurations and settings
- Infrastructure topology and relationships
- Resource utilization metrics
- Security group and network configurations
We do not collect, store, or process any of your business data, customer information, or application content.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
5. Subscription and Payment
5.1 Pricing
Uptime.cx offers subscription-based pricing plans starting at $99/month. Pricing is subject to change with 30 days notice to existing subscribers.
5.2 Billing
Subscriptions are billed monthly or annually in advance. You authorize us to charge your payment method for all fees incurred. Failure to pay may result in service suspension or termination.
5.3 Refunds
We offer a 14-day money-back guarantee for first-time subscribers. Refunds are not available for subsequent billing periods or for services already rendered.
6. Reports and Recommendations
Uptime.cx generates detailed analysis reports and recommendations based on your AWS infrastructure. You acknowledge that:
- Reports are for informational purposes and should be reviewed by qualified professionals
- You retain full ownership of all reports generated for your infrastructure
- You may share reports with your internal teams or external consultants
- Implementation of recommendations is at your sole discretion and risk
- We are not responsible for outcomes resulting from implementing our recommendations
7. DevOps Hiring Service
Uptime.cx provides access to AWS-specialized DevOps professionals. When using this service:
- You enter into a separate agreement with the DevOps professional or their employer
- Uptime.cx acts as a facilitator and is not party to the employment or service relationship
- We do not guarantee the quality, availability, or performance of third-party professionals
- Payment terms and conditions are established between you and the service provider
- Disputes should be resolved directly with the service provider
8. Service Availability
We strive to maintain high service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
9. Intellectual Property
The Service, including all content, features, and functionality, is owned by Uptime.cx and is protected by international copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works of the Service
- Reverse engineer or attempt to extract source code
- Remove or alter any proprietary notices
- Use the Service to develop competing products
10. Limitation of Liability
To the maximum extent permitted by law, Uptime.cx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
11. Warranties Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that defects will be corrected.
12. Termination
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Uptime.cx operates, without regard to its conflict of law provisions.
